In the first case Macpherson and Wilkins JJ state the purport of the Will to be that the testator's widow was empowered to "establish the service of an idol and by making a Will in favour of it to manage the properties construct a temple and perform the -sheba.' The idol not having been established the bequest was held to be void. [...] He has moreover taken great pains to bring out and explain the differences in the language as also the sense of the provisions of the old Code and the amended sections of the new Code. [...] The Pettioners stated that they instituted the present suit in the Court of the District Judge of Jhang in the Punjab on the 3rd October 1905 and claimed to succeed as reversioners to the estate of one Mansa Ram deceased on the death of his widow Musammat Har Devi in preference to his daughters Defendants in the suit by virtue of a custom ecluding the said daughters from inheritance. [...] The revenue authorities holding the Will proved mutated the property covered by the Will in favour of the Defendants and the rest of the prperty in the name of the Plaintiffs. [...] According to the Suits Valuation Act provision was made that the Chief Court of the Punjab should fix the value for the purposes of jurisdiction and for the purpose of the Court-fet ; and the practice in the Punjab is to take 3o times the jama and to value upon that.
