IF THE CONSTITUTIONAL POSITION OF THE NOofficial members of the Provincial Councils as we have explained above then it follows that in the new Council it will be the duty of the officials not merely to respect the opinion of the non-official members but also to modify their views and measures in deference to such opnion. [...] In the course of a pending action both the Plaintiff and the Defendant met together and compromised the action on certain termsoshich included the paymegt of some money 'Tull satisfaction of the claim and costs of the action. [...] Now the essential ingredient of the offence is that the property which the prisoner helped the prosecutor to recover is a property of which the prosecutor has been deprived by an offence punishable under the Code. [...] 414 of 1907 in the Court of the Subordinate Judge of Cuttack a decree by which the Defendant was directed to execute a kabuliyat as sarvarakar in favour of the Plaintiffs within two months from the date of the decree. [...] Their Lordships observed :- "In support of the rule it is contended that after the appeal had been filed the Subordinate Judge had no power under the law to modify his decree or to extend the period fixed in the decree for the execution of the kabuliyat by the judgment-debtor.
