All the same the reservation of the eastern etrance for the members of the legal profession their clerks and clients and the grand stair case to the south of the Court for the general public will facilitate the keeping of a careful watch on all those who may hang or stroll about the Courts or the corridors without any definite business. [...] (I) that the Government of India had no authority under the law to grant any lease of the maidan and (2) that the lands were held in trust by the Crown for the free use and enjoyment of the public and that the right of the public to use and enjoy it could not be cutailed. [...] make a payment and thereby to get a benefit the payment if not made within the time limited by the decree of the first Court will not entitle the party seeking to make the payment after the decree of the Appellate Court to get the benefit. [...] The Defendants preferred one appeal to the High Court and the decree of the first Court was rversed and the Plaintiff-Respondent was directed to pay to the Defendants-Appellants the costs of the appeal the details and amount of which were given and "the costs incurred by them (the Defendants) in the lower Court " without stating the amount thereof. [...] The DefendAts applied for the execution of their decree and prayed for the realization of the costs of the High Court and the sum total of the costs named against each Defedant in the lower Court.
