The law regarding the powers of alienation is made stringent enough in the Hindu law books to safeguard the rights of the sons and even the son in the womb. [...] The learned Judges say " in the case of a mortgage debt icurred by the father the debt is the primary oblgation and is binding on the son if it is not for an illegal or immoral purpose ; 40 the mortgage is only a collateral security for the discharge of the debt either by the receipt of rents and profits by the mortgagee or by causing it to be sold after the debt becomes parable.
