For if the power were given to the Sessions Court qua the Court of Appeal or the Court to which the commitment would be made it might with justice be said that the new Act by taking away from the Sessions Court the character of a Court trying the case on commitment also takes away the power which this Court exercised as such. [...] The adjustment of the mutual relations WITH REFERENCE TO tHE LAST POINT OF THE between the capitalist and the labourer as well as decisions we are afraid clic cannot quite follow the determination of the rights of either in respect of their Lordships. [...] But in the present case the cause of action is not the obstruction but it is the order passed by the Magistrate prohibiting the Plaintiffs from carrying on the religious procession. [...] whether under the circumstances appeaing above the said suit was maintainable without proof of special damage ; whether in view of the concurrent findings of the Courts of first instance and of first appeal the Plaintiffs are entitled to use the said streets for the purposes of their religious worship and processions ; whether notwithstanding the passing of the Madras Local Board Act (5 of 1S8 [...] The Munsif sullied that the total area as also the area of the parcels lost by the Plaintiffs was as stated in the sale-certificate and on that basis he dealt with the question raised in the 8th issue viz.
