The main objections taken by the landlords in bar of the suit were in effect : (I) That it was incumbent on the tenants to raise the question of error in the entries by way of defence in the prceeding under sec. [...] As in the present case the corectnes%or otherwise of the entries in the recoroi.rights had not infact formed the subject of the proceeding under sec. [...] Creditors cannot sue without the leave of the Court and the Court would he placed in a position of great difficulty if it should refuse to the creditor the right to proceed at law for the pament of his debt not at the same time providing any means to pay it in the event of his establising it. [...] A very strong case however must be made before we should feel justified in reducing the call for the official liquidator who stands now in the charater of an officer of the Court and whose duty it is to take a fair and proper view and make a just estimate of the amount of the liabilities of the company informs us that in his opinion an amount of debts will be established against the comp [...] Held—That the parties to the suit were in the position of counteclaimants and it was the duty of the Defendants as well as of the Plaintiffs to aid the Court in ascertaining the true boundary.
