In the first place theory of the identity of the father and son and of the father's quasi-proprietary rights over the son points to the conclusion that the.son goes with the father. [...] t)n the evidence it appears to us that i.t was a ituestion for the jury whether the Plaintiff understood the nature and effect of the document he was signing and therefore that the County Court Judge was wrong in withdrawing the case from the jury. [...] On-appeal the validity of the order was questioned on the grounds (1) that the magazine in question was not a newspaper' within the meaning of the Newspapers (Incitment to Offences) Act ; (2) that the poem in quetion was not of a character to justify an order for forfeiture under the Act. [...] 429 of the Criminal Procedure Code was the whole case and not the point or points on which the Judges differed and it is the duty of the Judge to whom the case is referred to consider all the points involved before he delivers his opinion on the case. [...] Accordingly his Lordship considered the question whether the Pallichitra was a 'newpaper' within the meaning of the Act and oserved : "The definition of newspaper involves two elements one of time of publication and the other of subject matter ; newspaper as defined in the Act involves the idea of p6riodicity as also the fact that what is contained in the paper is public news or comment the
