The Council firth express their own opinion that "in the case in question there was not anything improper in the conduct of counsel in letting the jury know (without mettioning the result) that the matter had previously been before the Court " The gist of the opinion therefore is that it is the better course for counsel not to mention to the jury about the previous trial and that it would be [...] The question must therefore be decided with reference not to the nature or the terms of the original contract of tenancy but upon a consideration of the relatioship between the landlord and the heirs of the tenant. [...] Some of the most brutal sentences provided in the earlier Hindu law such as the cutting down of the fingers of the pick-pocket and generally the limb by means of which the offence is committed go to show that the true objective of these punishments is the prevention of crime and not the satisfaction of revenge. [...] In every case the sentence is to be corn_ mensurate not with the sentiment of vengeance roused but with the amount of culpability judged with regard to the time and place of the occurence and the manner of committing the offence. [...] The said Permanand brought a suit against the sons of the said testator and in execution of his decree obtained against them a 5-biswas share (i e a fourth part) of the said village was sold by auction and was purchased by an agent of the Skinner estate and the purchase money was paid out of the funds of the said estate.
