We also thoroughly approve of the suggestion of our correspondent that even the District Magistrate and the Sessions Judge should take care to ascertain the opinion of the local Bar in making their recommendation for the appointment of the Government Pleader or the Public Prosecutor. [...] 13 of the Code so far as it relates to the retrial of an issue refers not to the date of the commencement of the litigation but to the date when the Judge is called upon to decide the issue.
