It was brought into the case to assist the jury to come to the conclusion that the murder was the act of the Seddons or one of them and that it was a murder not of passion or hatred or done in hot blood but was designed for the purpose of getting money or if they had got 148XV!.) THE CALCUTTA WEEKLY NOTES. [...] But not having sufficient materials to enable him to judge or to form the the conclusion that the owners of the Olympic were deliberately content to fight the case on the lines they did he was reluctantly driven to say that this malter of the further evidence ought to be postponed until the hearing of the appeal and it would be so postponed if he allowed the further evidence to be taken de here [...] At the trial the learned Judge left the following questions to the jury :—First were the Defendants themselves guilty of negligence; secondly was the fire escape a fit and proper one for its purpose ; thirdly were the Defendants' servants guilty of negligence in the management of the fire escape or in allowing the Plaintiff to pull it ; fourthly was the boy aware of the danger ? The jury answer [...] In the course of his judgment Loan JUSTICE VAUGHAN WILLIAMS said :- The findings and the evidence showed a strong case for saying that the plaintiff and the other boys who were with him were volunteers to assist those who had the naanagernent of the fire escape and that they were in the same position for the purposes of this case as if they had been servants of the Defendants in receipt of wages. [...] 21 of the Code of Civil Procedure but was whether in the face of the admission made by the father the two sons were entitled to succeed in the present application.
