Amongst the Calcutta capitalists and members of the commercial community there were apprehensions of loss of business fall in the value of land or of rent and in their interest or quite independently in the interests of the taxpayer a section of the Calcutta Press might have severely criticised the wisdcm of the transfer of the capital but no man out of Bedlam would have the hardhood to sug [...] IN THE CASE UNDER NOTICE AN OBJECTION TO the legality of the grant was urged to the effect that to allow such interests to be created would be to enable the grantor to create rights of prperty in favour of unborn or unascertained persons contrary to the provisions of the Hindu Law. [...] According to the usual practice the question of the recovery of the land alone' was at first gone into and the enquiry into the amount of mesne profits deferred. [...] It is to be noticed that the value of the land constitutes an essential factor in the computation of the value adopted by the High Court but what puzzles us is why in' such circumstances the decision on the question of the recovery of the land should not have been diregarded. [...] The scheme of the Dayabhaga is radically ditinct from and to some extent incompatible with the scheme of the Mitakshara and the one cannot be made to supplement the other so far as the law of inheritance is concerned.
