From the pleadings in the record and the judgments of the lower Courts it appears that the allegation was that the family was originally a family of Hindu Baishyas who became converts to Mahomedanism and who in spite of such conversion continued to follow the Hindu law of inheritance. [...] Under this arrangement the new University will retain the full advantages of a Law Deparment ; professors and students of law will enjoy the benefits of membership of the University and the difficulty with regard to the maintenance of a uniform standard and course of studies for entry into the legal profession will be ove-come. [...] 4. A sub committee of which an Hon'ble Judge of the High Court a distinguished member of the Calcutta Bar the Principal of the Calcutta University Law College and the Vice-Principal of the Dacca Law College were members advised us on the staff and equipment required to place legal instruction at Dacca on a satisfactory footing. [...] As to the order of the 2nd January directing the complainant (Petitioner) to prove his case in the presence of the accused their Lordships oserved :- The order was absolutely illegal. we may express our hearty concurrence in the codemnation pronounced by the former bench on the practice of conducting these preliminary equiries in the presence of the accused. [...] The appeal was by the Defendant in a suit for khas possession brought by the Plaintiff on the footing that the land in dispute fell into the Plaitiff's share on partition against the different Defedants.
