Where at the time of registration of a mortgage the mortgagor was present assenting to the registration of the document with full knowledge of what was being done although the document was presented to the regitrar by a servant of the mortgagee. [...] But the obligation of the Railway Company indhided not only the duty of taking all reasonable precautions to obviate risks but the duty of taking all proper measures for the protection of the goods when risks had actually occurred and the Railway Company were liable to the Plaintiffs to the extent of the damage which they might have prevented on the discovery of the fire. [...] The Appellants in this case were the personal representatives of Harry Rickards who was the Defendant in an action for damages brought by the Respondent against him in the Melbourne County Court for damages occasioned to the stock-in-trade of the Plaintiff who was the tenant of the second floor of certain premises belonging to the Defedant by an overflow from a lavatory basin situated on an up [...] Upon the findings of the jury the Judge at the trial directed judgment to be entered for the Plaintiff for 1561 the amount of the damages found by the jury. [...] The person who _did the malicious act in this case was obliged to do three distinct things to secure the success of his plan namely to open the screw tap to its utteost limit to block the tvaste-pipe from the bottom of the basin and to block the waste pipe from the overflow holes.
