The Court of first instance decreed the Plaintiff's claim allowing interest up to the time of the hearing of the suit. [...] An appeal was adjourned once at the request of the Appellants twice at the request of the Respondents and three times for the convenience of the Court. [...] It may be mentioned that the trial itself was conducted on the side of the prosecution as well of the defence with exceptional ability and the addresses to the jury by the Lord Avocate and the Dean of the Faculty make very instructive reading tioteo of easts. [...] 50 724-r 5-5 with interest from the 21st day of April 1909 on the grounds (a) that the Defendant has obtained payment of the said sum from the Plaintiff Copany by the fraud of his agent for which he is reponsible and (b) tha the Defendant has obtained payment of the said sum from the Plaintiff Copany without consideration." The Petitioner put in his defence to the said suit and denied [...] Held that the Defendant was bound to quit the holding on the expiration of the term of the kabuliyat.
