But the ruie in Dillct's Case (1883) which is the leading authority for the exercise of the prerogative in criminal appeals to the Privy Council supports the authority of the Board to review any case where the procedure of the lower court has rendered possible a denial of justice. [...] It appears that the areas of the different holdings entered by the settlement officer in the record-of-rights prepared by hm were so entered in acres and that if the standard of measurement claimed by tt.e Petitioner was adopted the acreage of the said areas and the rents payable by the tenants therefor would be considerably increased. [...] the village of Memuagar) the proper standard of measurement for both classes of land was that claimed by the Petitioner but that in the other 7 villages that standard was only applicable to the u bandi lands and that in respect of the jamai lands the longer standard contended for by the tenants was to be applied. [...] All the raid second appeals were heard together by two Judges of the said High Court who the Petitioner alleged notwithstanding the provisions of Chap XLII of the Code of Civil Procedure saibject to which the said appeals were filed went at length into the evidence recorded by the Court of first instance and disagreeing with the apprecition 'hereof by the said District Judge and differing fro [...] The Petitioner being dissatisfied with the said judgment applied to the said High Court for the necessary certificate entitling him to appeal therfrom to His Majesty in Council but the learned Judges before whom the matter came not being (as it appeared) satisfied that the value of the subjecmatter in appeal was of the value of Rs.
