the Plaintiffs was a Defendant and the father of the other two Plaintiffs who were then minors was the Plaintiff the matter substatially in issue in the present case was substatially in issue but the finding of the Court which decided the case was that the father did not adequately represent the minors. [...] In an introduction of some 35 pages the author gives a comparative history of the law relating to oaths under the Hindu the Mahomedan the Roman the French and the English systems of juriprudence. The statements of facts of the cases cited and of the points decided are so full that so far as the case law goes the compilation is fairly exhaustive. [...] The complaint was that the learned Judge had told the jury that they must find either accident or murder and the question was whether on the evidence the Judge ought not to have left to the jury the opportunity of finding a verdict of manslaughter. [...] * * With regard to the suggestion that as the defence at the trial was that this was an accident the Judge would not have been justified in putting forward the defence of manslaughter ; the Court wished to say that whatever the defence raised by counsel it was for the Judge to put such questions to the jury as appeared -to him to arise upon the evdence even though they were not put by couns [...] Held that the suit should not have been dimissed as the share in the land which the Plaintiff claimed admittedly belonged to him and that the fact that the Plaintiff's co-sharers etered into a separate arrangement with the tenants did not prevent the Plaintiff from suing for his share of the rent.
