The Royal prerogative and this Common Law right of the Sovereign over the property of the subject has found during the present war legislative expression both in England and India in the Defence of the Realm Act (Defence of India Act No. [...] The prerogative right of the Crown at the time of war stands on altogether a different footing from the right of the State to acquire land for public purposes and even for military purposes in the time of peace. [...] The above is a collection of the Rules under the Bengal Tenancy Act as made by the Local Government and by the High Court with up-tdate amendments together with extracts from the Civil Procedure Code and the Bengal Survey Act referred to in the Rules. [...] It is the Prerogative of the Crown to take possession of subject's land in time of war witout compensation for securing the public safety and the defence of the realm.
