The recent request by the Secretary of State kr India to the Government of India to the effect that two gentlemen should be selected by the latter to advise the former regarding the questions that may be discussed at the fortcoming Imperial Conference is rather ambigous as to what is likely to be the pesition and functions of the gentlemen who may be so selected by the Government of India. [...] The reticence of the Secretary of State is no doubt due to the fact that the decision with regard to this ' matter will rest with the Conference and not with the Ministers of the Crown. [...] 13 (1893) has thus observed : The contract did not pass any right title or interest in the property to the purchaser but merely gave hint a right against the vendor persomilly to call for a coveyance and possession on paying the balance of the purchase money.- That learned Judge finally declares that even after the contract the vendor remains the owner of the property and as such his interes [...] This is literally true; but for the purpose of protecting the attaching creditor's interest the sale following the attachment ought to relate back to the time of the attachment so much so that the two should by a fiction of law be taken together as one or in other words the intervening time between the two should be taken as non-existing. [...] Ill implies that the Court requires some time to complete the sale for the benefit of the attaching creditor and as Court's actions can prejudice none the time so taken by the Court should on no account he reckoned to the detriment of the said creditor.
