The fact however that the law has now been finally settled by the Highest Tribunal in favour of the Zemindars will not alter or affect the belief generally held in this country that the decisions of the Judicial Committee have proved a winfall to descendants of improvident Zemidars who in the spacious days which will never return would carve out estates for all the world like estates in f [...] The general rule is that all proceedings taken in a Court of law should be held in the presence of the accused and in such a manner as to make them intelligible to the accused but in ability to understand the proceedings does not necessarily exempt the person charged with the commission of an offence from punishment. [...] 341 which enacts that if the accused though not insane cannot be made to understand the proceedings the Court may proceed with the inquiry or trial ; and in the case of a Court other than a High Court if such inquiry results in a comitment or if such trial results in a conviction the proceedings shall be forwarded to the High Court with a report of the circumstances of the case and the High C [...] XXI r. 89 an applcation such as this can be made by any person either owning the property or holding an iterest therein by virtue of a title acquired before the Court sale and a judgment-debtor in the position of the present applicant is still the owner of the property in the eye of the law the auction sale being still unconfirmed. [...] 76 of the Act that the Petitioner who was an officer of the Company was knoingly a party to the default in holding the general meeting.
