103 were totally ignored by the SuInspector but it was argued in support of the cony ction that the provisions of the section were purely formal and noo-compliance with the same would not in validate the search and therefore the officer coducting the search in spite of his ignoring the provisions of that section was acting in the dicharge of his duties and interference with Min would con [...] The first offer of title was a defective one.- The purchaser " merely declined to accept the title in the first of a set of requisitions dealing with the absence of a power of sale and other points on the title. [...] The ' District Judge adjourned the case for the purpOse of rcording the evidence and the evidence that might be adduced on behalf of the Common Manager and for deciding other matters raised by the co-owners: The co-owners thereupon moved this Hon'ble Court and made several prayers in their petition one of which was that the Common Manager could not be made a party. [...] Owing to the m scalculation by the 'Appellant's yak I of the period of limitation the appeal was filed on the re-open ng day whereas he ought to have filed the same on the day on which the High Court was closed for the Puja Vacation in 1919. [...] The Oppos.te Party (IA not oppose the Rule : Held—That as the default was caused by the miscalculation on the part of the vakil for the Petitioner the Rule was made absolute (12 C. W. N. 25 referred to).
