The subordinate judiciary have all along been under the control and influence of the High Court having had practically nothing to do with tho executive Government and the opportunity for doing justice between the parties fairly and to the satisfaction of the public has very Often been ascribed to the fact of the controlling authority being the High Court. [...] If that be so the High Court and the Government ought to increase the strength of the service esneoially having regard to the-fact that the administration of civil justice leaves a handsome surplus to the Government. [...] On a certain date of hearing the Defendant was present in Court for conducting his case and the suit' was settled by compromise and the surety applied to be dicharged : Held—That the presence of the Defendant in Court for conducting his case at the time when the surety asked the Court to discharge him from obligation was not a compliance with Or. [...] When a suit abates on account of the death of the sole Plaintiff the right to sue not surviing and it is dismissed in consequence the Court has power to make an order granting Defenant's costs out of the estate of the deceased. [...] the date of...the Nigh Court decision in' the previous litigation by the Plaintiff's 'Elison OnAppeal by the Plaintiff the lower Appellate Vourt affirmed the decision of the Court of first instance.
