it is the policy of the new Act passed by Parliament to introduce parliamentary life amongst the people of this country and for this purpose it has been proposed to pay parttilai attention to the case of the eultituitors w form the bulk of the population. [...] Those who have espoused the abolition of the present system have generally overlooked the fact that the King is the source of our Law and the FouBtain of ; and that it is the inherent right of every subject. [...] On December 18th; 1917 the Plaintiff who had been a tenant `to the Defenant of the same premises and was liable to him under a covenant to repair less onerous than those in the three leases above-mentioned agreed to purchase and on May 1st 1918 took a conveyance of the fesimple of the premises together with the benefit of the covenants in the head-lease. [...] Thereupon the Plaintiff obtained an assignment of the full benefit of the lessee's covenants to repair cotained in the sub-under-lease and commenced an action against the Defendant as assignee of the sub-under-lease for breacheof the lessee's covenants therein : Held—That the assignment was free from objection on the ground of maintenance or champerty the right of action on the covenants b [...] His position is in the eye of the law the same as if he had been able to bring this action under the assignment which he took from the original free-holder." There has been a tendency in the Courts to restrict as much as possiblil the scope of the rule that an assignment of avmere right to sue is bad and unenforceable.
