There is no provision in the Code of Civil.Procedure for payment of any cat for the preparation of the Paper-book at the time of the presentation of the appeal or at a subsquent. [...] IX r. 39 of the High Court Rulea the High Court can dismiss the appeal for want of prosecution if the Appellant makes default in complying with the rules for delivering the list of papers or for depositing the cost of the Paper-book.
