tions “ The following communique issuea by the Governmnent of India on the 10th of Deceber last unless explained by reference io the debate — on the question in the Legislative Assembly on the 20th of September -last likely to create a misapprehension in publc mind that the Government of India is ndt favourable to the question of separation of the executive and judicial functions. [...] The comunique we refer to is in the following terms — The Governor General in Council has expressed his inability to accept the resolution of the Legislative Assembly adopted during the last Simla Session regarding the separation of Judicia and Executive functions on the same grounds as stated in the debate by the Home Member' in opposing the motion. [...] the principle of the separation the majority of the House including the mover of the amendment voted in its favour. [...] I Thus it will be seen that the Goernment of India communique' only follows the net result of the debate and in no way trenches upon the assurance given by the Home meber in the course of the debate. [...] 2. The parties in the second case are Bugti Bilochis and the claim by the 'Plaintiff-Apellant was for possession by pre-emption a collateral of the alleged vendors of the land in suit.- The suit was decreed by the District Judge of Dera Ghazi Khan.
