54 of the Act which says : “Subject to the provisions of the Code of Civil Precedure applicable to appeals from Original Decrees an appeal shall lie to the High Court from the reward or any part of the award of the Court in any pi ceediugs under the Act” This special and limited right of appeal it was said was ehausted by an appeal to the High Court and was not enough to take the matter up [...] but even this inconvenience operates in lesser degree in relation to the latter than to the former class When thdocument is one on which the Plaintiff sues he must produce it in Court when the plaint is presented and shall delver the document to be filed with the plaint But if the document be in the nature of an account book which is for daily use of the party the Plaintiff is to produc [...] The copy with the certificate is to be presented in the record oT the case along with the plaint and the original is to be returned to the Plaintiff who is required to produce the same-at the trial of the case. [...] enc of a document at the date of the suit the Cart should admit the document in evidence even though the document was not produced with the plaint or entered in the list of docments annexed to the plaint W. It is to be observed however; that in the mofussil courts the rule as to the production of list of docments relied upon by the_Plamtiff as evidence pr support of his claim is followed [...] In the former class of suits the date faxed after the service of summons cannot be said to be the first hearing of the suit while in the latter class of cases the date fixed after the service of summons is the first hearing day.
