On the date of the filing of the suit the pecuniary jurisdiction of the Munsif was Rs. [...] No fixed amount of mesne profits was estimated in' the.plaint bLnt the prayer in the plaint was that the aftioutat might be determined at the time of the execution of the decree. [...] The lower Coerts upheld the objetion of the Defendants but the High Court rjected the contention and held that the Munsif had jurisdi&ion to decree the claim of the Plaintiffs though it exceeded his pecuniary jurisdiction. [...] of the amount exceeding the sum awarded by the effort executing the order or should have no remedy at all in that respect." In this case the learned Judges did not decide whether if the amount of mesne profits claied for the period before the instituon of the suit ' added to the value of the land exceeded 18"THE CALCUTTA WEEKLY NOTES. [...] The defence alleges that' the action of the Government necessitated by the war had prevented the mills from supplying the goods to the buyer.
