Owing to the activities of the non-co-operation movement during the Prince of Wales’s visit the Criminal Law Asnendment Act Part II was made use of for the arrest and imprisonment of the Congress and Ehelafat volunteers and the repeal of Part 1.1. [...] Although there was consideTable doubt about the legality of the course then adopted by the Government the Legislature did not object to its repeal being doferred The non-co-operators have done a distinct disservice to the rigl4ts and liberties of the people of this country by not questionipg the legality of the Executive prclamations under the Act. [...] It hae been pointed out to us that for the protection of the frontiers of India and the fulfilment o the reponsibilities of the Government of India in relation to Indian States there must be some enactment to arm the Executive with powers to restrict the movements and net138"VOL. [...] Was are In fact satisfied of the continued necesity for providing for the original object of this Regulation in so fir as.it was expressly declared to be ` the due maitenance of the alliances formed by the British Government with Foreign Powers the preservation of tranquillity in the territories of Native Princes entitled to its protection and the security of thq British Dominions from fo [...] The present Article traces the Criminal jurisdiction over such persons with reference to the powers of the Legislature and the Courts of law ftoon early times and indicates the varitms alterations introduced by the Act.
