An alienation by the widow for consideration or without it to a stranger with the assent of the next full heir or to one of the next heirs with the assent of the others must also be allowed for the same reasons But tfie if: is one imporant flaw in the latter case. [...] by the widow the consent of the next heir is open to the objection that it is of it necessitous Or reckless man. [...] Now rematns the last question as to how far the consent of the next heir is evidence of justifying cause for the alienation by the Nvidotv. [...] The Opposite Parties filed an avpliclion for amendment of the decree to the Ditrict Judge as at the date of the appliotion there was no Additional 'District Judge of Noakhali. [...] The rule was te-(1 on the ground that the Subordinate Judge had.no jurisdiction to amend the detTee passed by the Additional District Judge : Held--Upon review of the several sections of the.Bengal Civil Courts Act NH of defect that though there may be a technical defect in the lower Court's order the High Court should not interfere in revision where substatial justice has been done.
