537 of the Code of Criminal Procedure which is intended to cure certain defects of procedure in a trial unless failure of justice has actually been occasioned is frequently misapplied so as to bring about the result which according to the spirit of the section is the only justification for the reversal of a trial. [...] The case of Ramyad Dusadh v. The King-Emperor 1926 (Pat.) 13 is an instance of a new source of trouble ariing out of the invocation of the aid of sec. [...] This is the proper way of giving effect to the intention of the legislture as expressed in the section of the statute. [...] The facts of the case in question are somewhat peculiar It appears that in cross-examination of the prosecution witnesses on behalf of the accused the damaging fact was brought out that the accused had in fact been mentioned by the witnesses before the police and this portion of the -evidence was considered and relied on as 43."atilt THE CALCUTTA WEEKLY NOTES.
