The Select Committee made many changes in the bill as originally framed and as appears from the statement made in Council by the Hon'ble Member in charge of the bill Government was not prepared to approve of those changes which were not consistent with the policy of the Government in framing the bill. The language of the section was altered in the Code of 1898 into " nor shall such writing be used as evidence " and under the Code of 1898 it was held that oral evidence of the slatment made to the police was admissible to corroborate the evidence given at the trial under sec. [...] The proviso could never have been intended to allow the prosecution to ipeach the credit of its own witnesses for its own purposes and against the wish of the accused by reference to police testimony."
