The essential diffeence between the 1923 draft-and the subsequent drafts is that while the foormer is a constitution of a unitary state the later ones are drafted on the lines of a federation. [...] V specifies the powers of the National Government the Provincial Goverments and the Districts: As in America the highest Court of justice is vested with powers to decide any dispute between the National Goernment and any of the Provincial Goverments as to their respective spheres of legisltion as assigned by the constitution and to dclare laws passed in contravention tnereof ultr [...] The executiv-e power is to be execised by the President of the Chinese Rpublic with the assistance of the Cabinet Ministers. [...] The Municipal Magistrate made an order of demolition of the structures in question and against that order the Petitioner moved the High Court and o- tamed a rule on the ground that the procedure adopted by the Magistrate had been illegal and the entire trial had been vitiated inasmuch as the Petitioner had been examined as a winess and subjected to cross-examination 71"lxxii THE CALCUTTA WEE [...] The mistake was hoever subsequently corrected and his evidence was taken but his evidence was not admissible without a tender to and acceptance by him of a fresh pardon in the Sessions Court : Held—That as at the sessions trial the Judge corrected the mistake by removing the approver from the dock to the box he was not an accused in the trial and was a person copetent to give evidence.
