In the case of Owen v. Lord Rothermere (the Northcliffe case) reported in the columns of I the Times of the 12th and 16th February last the vexed question of the authority of Colin-. sel -to deal with a case as he thinks best in the interest of his client came up and was disposed of by Astbury J. in a. way which is worthy of note. [...] Passing questions of evidential admissibility on to the jurors "cumbers the jury with legal definitions and offers an additional opportunity for quibbling over the tenor of the instructions." To quote another authority " The refeence of the preliminary question and the consideration of the merits to the jury at the same time would perplex and embarrass their inquiries--greatly increase the [...] Nor is the purely legal interest of the book small for following the usual plpn of the series it gives the proceedings in Court in full with rotes even as to the demeanour of parties and witnesses so that a reader may easily rconstruct for himself the very atmosphere of the trial and view it in retrospect. [...] Akron.) for the Appellants.— The chargers relating to the assault on the Police and the rioting in the Gas Street could not be jointly tried with those arising out of the incidents regarding the constable the two icidents being entirely distinct and separate and not having taken place in the course of the same transaction. [...] After the unlawful assembly had been dispersed it ceased to exist and the aduction of the constable was the result of an after-thouht entirely unconnected with the common object of the assembly.
