In reviewing the speech of.Lord Lytton with which he opened the last session of the Bengal Legislative Council we pointed out that he had put an interpretation on the powers of the Governor under the Instrument of Instructions in the matter of selection of Ministers and their removal from office which was in accordance I with the most approved constitutional practice that had been followed in th [...] 82 of the Code of Criminal Procedure of 18'72 the right of the High Court to issue a writ of habeas corpus to the Mofussil was expressly taken away by the legislature and _so long as the Code of 1872 was in force no writ of habeas corpus couldl a--i-g.sueLby the High Court beyond the presidency towns. [...] 82 of the Code of 1872 was passed to nullify the effect of the ruling in Amir Khan's case as to the writ of habeas corpus going to the Mofussil and the effect of the passing of the Code of 1882 in which sec. [...] As to the effect of the dropping of the prohbitory provision on the subject of habeas corpus it has been contended that the effect is not to revive the right of the High Court to issue the writ in view of sec. [...] 21 r..90 of the Civil Procduce Code for the setting aside of the sale on the ground of fratickilent suppression of the sale proclamation and the writ of attachment.
