The action of the High Court in issuing this notification not only meets the ojections that had been taken to the promulgtion of the Rules but also assures those cocerned and the public generally that the reprsentations made to the High Court in the press and elsewhere are receiving careful and sypathetic consideration. [...] P. Code do not apply to searches made under the Excise -Act and that it was not the intention of the legislature to extend the special provisions relating to search under the Criminal Procedure Code to searches held under the Excise Act. [...] 16319G dated the 6th December 1426 in the Gazette of India of the 11th December 1996 and in the Calcutta and Assam Gazettes of the 16th and 15th idem respectively regarding the admission of persons as pleaders in the Courts subordinate to the High Court are suspended until further orders that it is proposed to revise and amend those Rules and that when they have been revised they will not [...] The Munsif in coming to his conclusion oserved as follows :—" in the present case the' main contest is not for the tenancy but the cotest is between the Defendants as to who is the real tenant." Against.this decision the Plaintiff preferred an appeal to the Subordinate Judge of Howrah. [...] that the Subordinate Judge had no jurisdiction to entertain the apeal as no appeal lay to him having regard to the provisions of see.- 153 of the Bengal Teancy Act.
