In the case under rotice one of the parties undertook to give up so much of his claim as would be denied by the other party in the prsence of an idol and the question was whether any special invocation of the deity was neceiry before making the deposition in order to..galise it and the airwer given by their Lorships is in the negative.. [...] To hold that each time a person wishes to take a. special oath in the presence of an idol there must be an invocation of the deity is to presuppose the non-existence of the Divine Being in the idol ; whereas the Hindu notion is just the opposite. [...] The continuous existence of the Divine Being in the idol is the basis of the rule that the worship or skeba of an idol cannot be in abeyance for a single day. [...] The witness died a. few days aftewiirds and her evidence was used at the sessions trial and the Sessions: Judge refused the applcation of the accused to cross-examine the tivestigating police officer on the statement said to have been made to him by the witness andesc THE CALCUTTA WEEKLY NOTES. [...] There was no dispute with regard to the boundaries of the tenure except as to how the line should be drawn to demarcate the extent of the tenure towards the east.
