303 of the Code of Criminal Procdure lays down that the jury shall return a verdict on all the charges on which the acused is tried and the Judge may ask them such questions as are necessary to ascertain what their verdict is the only justifiction for the Judge questioning the jury after the verdict is returned being to ascetain what the verdict is. [...] 55) and the view expressed may be said to be consistent with the recognised principle of law that the jury are the sole judges of fact and the opinion of the jury is its verdict and not the reasons upon which the verdict is based. [...] It may be of very great assistance to a Judge to know the reasons for the verdict of the jury to make up his oWn mind whether it is necessary to differ - from them or not but the mischief likely to result if such a course is allowed is manifold and therefore in accordance with the fundamental principle and scheme of trial by jury the legislature had made it illegal for a Judge to question the jury [...] Every body perieps felt an itch for the statutory recognition of the doctrine and the reconciliation of judcial divergence as to the application of the rule pitted against the provisions of the Registration Act and as to the circustances attracting the operation of the rule. [...] The Appellant in this case was the Head-nkaster of a High School at Jangipur and ftsidecl for some time in the hostel attached to the school with the permission of the Secretary.
