1928

The appointment of Sir Nalini Ranjan Chatterjea the retired Judge and for somtime officiating Chief Justice of the Cacutta High Court to 'officiate as a member of the Executive Council of H. E. The Governor of Bengal in the place of the Maharajah Khaunish Chandra Roy of Nadia is considering the personality of Sir Nalini Ranjan a very happy and wise seletion. [...] The Bill that was intrduced in the Indian Legislative Assembly the year before last sought to afford some prtection against such attacks but there was a good deal of force in the argument that was advanced in opposition that this would place a dangerous weapon in the hands of the judiciary to curtail the liberty of the' press and legitimate criticism. [...] On appeal by the Defedanlos the lower Appellate Court held that the presumption arising out of the entry in the record-of-rights which was in favour of the Plaintiffs had been rebutted by the dcrees obtained by other co-sharer landlords and gave the Plaintiffs a decree at the rate admitted by the Defendants. [...] A preliminary objection was taken to the maintainability of the appeal on the ground that the Court of Appeal below having given a decree at the admitted rate there was no decision as to the question of the amount of jama within the meaning of sec. [...] It is not a case where the Court merely proceeded on the admission of the Defendant; the janta dcreed corresponded to the figure admitted by the Defendants." The decrees obtained by the co-sharer landlords were not admissible in evidence.
