An attempt to keep back any of the latter from the knowledge of the public is an attempt to keep back a part of the law; and to legislate in a manner that would preclude certain judgments from natural operation is to set one machinery of law-making on obstructing another the constitutional impropriety of which is patent:. [...] The result of this will be to create a sort: of private property in a branch of the law to the use or enjoyment of which strangers could not be admitted except by the grace of the owners. [...] In spite of this difficulty it might to a certain extent be possible in the superior Courts to keep abreast of the case-law; but in the ditricts which must chiefly be considered most of the decisions must remain unknown inamuch as it will be beyond the resources of the lawyers there to equip themselves with certified copies. [...] The correct value of an opinion is better reached by a.entymwroe of ideas and the test of the soundness of a view is its power to get itself accepted in the face of contrary views and opinions. [...] On this point the existing Act leaves it to the discretion of the Judges to permit the citation of private reports and is careful to confine the limittion to cases decided by the High Courts in India.
