The history of the office of the Speaker of the House of Commons is a very chequered one. [...] The success of his office depends as much on the sterling qualities of his character and judgment as on the spirit of discipline amongst the members of the House of Comons. [...] But the necessity for the exclusion disappears in a case when the truth of the confession is guaranteed by the discovery of facts in consequence of the iformation given. [...] It is this guarantee afforded by the discovery for the correcness of the accused's statement which is the ground of the exception to the general rule embodied in sec. [...] 43 of the Indian Contract Act it was not necessary to implead the firm as a whole as in a suit upon a contract made by a partner on behalf of the partnership the promisee can compel all or any one of such partners to perform the whole of the prmise and nojoinder of a co-promisor is no ground of defence to such a suit.
