The Home Member of the Government of India informed the House that the Government of India would not vote but would leave it to the non—official members to decide the question. [...] Until this decision of the Judicial Comittee of the Privy Council the legal practtioner Overseas was unable to advise with any degree of certainty on the right of his client to apply to successive judges of the same Court for a writ of habeas corpus for although the Lord Chancellor stated in his judgment that Counsel had called attetion to the fact that no instance could be found in the [...] The head-note as given in the' English and Epire Divest is as follows :- An applicant for a writ of hareax tenons has the right to take the opinion of every Judge and every Court as to the propriety of the detention complained of end the Judge or Coot is bound' to consider the question independently of any previous 4ecision Re: Boucher according to the paragraph set out in the English and [...] In Re: Bowack the head-note of which is in practically the same words as the heanote in the English and Empire.Digest of Ex parte Rowlands an objection i o an aplication for a writ of habeas compus to Walkot' J. a Judge of the Supreme Court of British Columbia on the ground that a previous application had been made to aother Judge of the Supreme Court was overruled ; and in Rex v. [...] Whether it was by mistake or.carelessness the amount awarded by the High Court was not entered in the decree the result was that the execution was levied for a portion of the decree which the Plaintiff had obtained against the judmendebtor.
