If the applicant cannot persuade the Court to call for the record of the case there is an end of the matter and there can be no reason for the Union Court to postpone the trial any further. [...] The case is as folows:— A (Plaintiff) filed a suit against 11 in the Union Court R appeared and notified to the Union Court under setion 81 of the Act that he had applied for the transfer of the case to the Court of the Munsiff. [...] The Defendant on the other hand was filing his hajira in the Alunsiff's Court and awaiting the fate of his application bat the Munsiff had to adjourn the hearing of the application for want of the record so withheld by the Union Court. [...] But the District Julps counting 30 days from the date of the Union Court decree found the application of R out of time end having refused to apply section 5 of the Indian Limitation Act rejected the prayer. [...] 88 fixes the limitation expressly and a? such it excludes the application of the Limitation Act in the matter of motions against the orders of the Union Courts before the Ditrict Judge.
