31 prvides for the order of the Court on the accused when he is convicted to re-pay to the complainant the fee paid on the petition of complaint in a non-cognizable eve or levied after the examination of the complaiant in such case as also the fees paid by the complainant for the service processes. [...] In case of.oral complaints of non-cognizable offences if the Magistrate in his discretion does not remit the payment the fee of one rupee may be realised on the examination of the coplainant. [...] In case of oral complaints of cognizable cases there is no provision for the realisation of the fee of one rupee on the examination of the complainant as in cases of oral complaints of nocognizable cases. [...] 31 of the Court Fees Act empowered Magistrates to direct the -accused when convicted to repay to the coplainant the fees realised on petitions of coplaint or on examination of the complaiant on oral complaint or for the service of processes. [...] Admittedly the Plaintiff paid off the mortgage in favour of B.
