the Imperial Conference of 1926 Australia and the other Dominions have put forward the further claim that the Governor-General should as in the Free State be appointed by the King on the nomnation of the Dominion Ministers. [...] The sixth principle is to the effect that the form in which the Instrument of Intructions to any Governor-General should embody the above principles must be detemined by the Government of the Dominion concerned. [...] So long whenever reference& were made to the Crown " in the literature of constitutional law care was taken to suordinate the personality of the king to the institution of the Crown: the " Crown " was said to be the link between the constituent parts of the Empire not the " King." In the principles quoted above the word " Crown " is avoided and every principle emphasises that whatever rela [...] On the expiry of the term of a Dominion Governor-General it will be for the Dominion Government concerned to move first in the matter and the King can act only when a request has been received for the appointment of a successor. [...] The suit was dismised by the trial Court on the ground that as soon as the decree in C's suit was passed the original attachment was restored; consquently the sale of the car to S was void uder sec.
