Sanyal has taken exception to a part of my correspondence relating to the principle that by the law of England the authority of an agent is determined by the death of the principal whether the fact of death is known or not. Anson also puts the point thus: " The death of the principal determines at once the authority of the agent leaving the third party to his remedy against the agent for breach of warranty of authority in case of contracts entered into by him in ignoance of the principal's death." [...] Where a Hindu widow made a gift of the entire property received from her huband in favour of her son-in-law with the consent of her daughter and the next male reversioner and subsequently adopted a son and the adopted son brought a suit to set aside the gift: Held (PATKAR J.)—That the gift was not binding on the adopted son ; that although the gift was made with the consent of the persons who [...] Such presumption does not arise in the case of a gift and therefore a gift with the consent of the next reversioner is not validated by the consent; that the gift will be binding on the consenting reversioner on the ground of estoppel.
