These provisions are the embodiment of the practice of the Laing of a criminal information " under the English law by the Attorney-General or a private individual. [...] Besides I would expect you to agree with me that in view of the conflicting and cotrs dictory or confusing findings of four different Benches on the same facts as rgards the forum and the application of the particular provisions by the Letters Patent the Hon'ble Chief Justice very unjustly rfused my prayers for forming a Special or Full Bench under sec. [...] 561A of the Criminal Procedure Code to remove or " prevent " the apparent " abuse " of the process of law or Courts or the confusion of its findings by exercise of the Court's inherent powers uder sec. [...] Thus the admitted or uncontradicted facts and a closer study of the High Court Rules and Letters Patent and a reading between the lines of the various decisions of the High Court as before said will convince you that there has been a gross miscarriage of justice in this case. [...] Where certain statements made to the Police by the accused were recorded and the accused made certain statements in Court the Police Officer was asked whether statment similar to the subsequent statement was made to the Police and the Police Officer answered in the negative: Held (BEAUMONT C. J. and MURPHY J.) —That the questions and answers were not admissible under sec.
