In this case the question relating to the repective legislative powers under the British North American Act of 1867 of the Parliment of Canada and the Legislatures of the Provinces with regard to the regulation and control of areonautics in Canada was rferred by the Governor-General in Council to the Judicial Committee for decision. [...] The question in the Canadian case refered to was whether the Parliament and Government of Canada have the exclusive legislative and executive authority for peforming the obligations of Canada or of any Province thereof under the convention etitled “ Convention relating to the Regultion of Aerial Navigation.” The Supreme Court of Canada answered the question in the negative but the Ju [...] 92 of the Civil Procedure Code 1908 with the cosent in writing of the Legal Rentembrancer of the United Provinces claiming the rmoval of the Defendants as trustees and for the appointment of new trustees and for other incidental relief. [...] The appeal arose out of an action brought by the Plaintiff for the rendition of the acounts of a dissolved partnership and for the recovery of the money due to them. [...] That rule finds expression in paragraph 16 (2) of the Second Schedule to the Civil Procedure Code and the mere fact that the validity of the reference was ipeached by Mussammat Wiranwali on the grountl that she was not a party to the reference does not take the case out of the ambit of the rule.
