Thereafter he created a fresh tenancy in favour of the son comprising a part of the lands of the jote and on what appears to have been a lump rent the kabliyat reciting that the entire lands of the old jote were in the khas possession of the lanlord. [...] In the second place it again entails some strain on one's sense of facts to conceive that at the date of the suit the son's possesion to the extent of the sisters' share Was their possession while his possession to the extent of the remainder was possession uder the kabuliyat. [...] Assuming therefore that the son's possession to the extent of the sisters' share was the latter's possession it is difficult to conceive what other possession the son could Kaye in fact which he could alone attribute to the kabliyat." Possession on facts such as existed in the present case can only be one and idivisible: since the sisters' undivided share affected the whole the s [...] The case would certainly have been different if there had been a finding that apart froni the abstract continuance of the sisters' posession the son was always on the land in fact in spite of the landlord's decree against him that when the landlord executed the decree he only obtained joint possession with the son who was possessing on behalf of the sisters and that after the kabuliyat th [...] We draw the attention of the Hon'ble the Chief Justice and the Registrar to the iconvenience that is being caused to the prfession by late publication of the Daily Cause-List of the Appellate Side.
