The crucial date is the date on which the Magistrate takes cognizance of the offence and if on that date there is or prior to that there has been in existence a judicial prceeding in relation to which the offence is alleged to have been committed it is abslutely necessary that the Magistrate should have before him a complaint in writing of the Court in which the judicial proceeding is pendin [...] 105 of the Act for settlement of rent either by the landlord or the tenant it is open to the other party to raise the issues specified in sec. [...] The effect of the evidence as set out in the depositions should be determined by the Magistrate after considering the case as a whole and endeavouring to take a broad and common sense view of the situation.
