The Earl of Lytton when he was Governor of Bengal was prepared to dismiss the ministers dfeated by the Swaraj party in Bengal and) called upon the leader of the Swaraj party to form a ministry and work the constittion but they refused the offer and persisted in the policy of barren obstruction and compelled the Governor to suspend the costitution and exercise his extraordinary powers. [...] The fact that he shall be the Commander-in-Chief of the Army and the Navy and States-Militia when actually called into the service of the United States has no application to the Indian Constittion. [...] The prerogative powers of the King under the British Costitution were sought to be conferred on the American President but even such powers as the declaration of war conclusion of peace the making of treaties are all subject to the control of the Senate. [...] On 5th December 1932 at the request of the supreme Court of Penang an order was made by the High Couk for the Official Assignee of Madras to act as auxiliary to the Official Assignee of Penang and take possession and reitlise the assets of the Bankrupt. [...] If his power of disposal of the property was at that date unaffected then the rule of international law will prevent any interference in the territory where the immovable property is with the right of the Official Assignee to get hold of the property.
