The strongest bulwark of the liberties of the subject is the High Court and the strongest foundation of that bulwark is sec. [...] " to keep the subordinate Courts within the bounds of their authority to see that they do what their duty requires and that they do it in a legal manner." The meaning of that is that in relation to a considerable sphere of their work the subordinate Courts will be placed in a position of irresponsibility which is a far worse form of irresponsibility than the irresponsibility of the executive. [...] In spite of the rigorous and illiberal character of many of the recent laws and the union of the judiciary and the executive in the crimnal jurisdiction the subject has so long felt protected by the ultimate authority of the High Court to intercede in his behalf. [...] In the course of three years he effected vast Improvements in the various departments of the High Court office and introduced dicipline and order; and the thorough knoledge he acquired of the business of the Court and at the same time of his men enabled him to direct the huge establishment with a success that has rarely been attained. [...] At the same time the next friend has a right to ask that he should have liberty to proceed against the estate of the minor in exercise of his right of indemnity or to protect himself as he is entitled to get not only these costs out of the estate of the minor but all costs changes and expenses which have been prperly incurred in conducting the suit on bhalf of the minor.
